Terms and conditions
These terms govern your use of aldenandroe.com and any purchase you make from it. Placing an order means you accept them.
1. About us
This website is operated by Alden & Roe LLC, a limited liability company registered in New York State, with its principal place of business at 214 Mercer Street, Suite 3B, New York, NY 10012, USA. References to "we", "us" and "our" mean Alden & Roe LLC. You can contact us at hello@aldenandroe.com or +1 (212) 804-7719.
2. Using this site
You must be at least 18 years old, or the age of majority where you live, to place an order. You agree to provide accurate information and not to use the site for any unlawful purpose, to attempt to gain unauthorised access to it, or to interfere with its operation.
3. Orders and acceptance
An order placed through the site is an offer to buy. It is accepted only when we send you a dispatch confirmation email. Until then, no contract exists between us.
We may decline or cancel an order if:
- The item is out of stock, including where stock is oversold because of a system error
- A price or description was listed in error, as described in section 4
- We reasonably suspect fraud or a breach of these terms
- The delivery address is a freight forwarder or is outside the countries we serve
If we cancel an order that has already been paid for, we refund the full amount to your original payment method within 5 business days.
4. Pricing, taxes and errors
All prices are shown in US dollars and include applicable import duty on US orders. Sales tax is calculated at checkout from your delivery address and shown as a separate line before you pay. For Canadian and UK orders, import duty and local taxes are payable by the recipient on delivery, as set out in the shipping policy.
We take care with pricing, but errors happen. If an item is listed at an obviously incorrect price, we will contact you before dispatch and give you the choice of paying the correct price or cancelling for a full refund. We will not simply ship at the wrong price and invoice you later, and we will not charge you more than the price shown at checkout.
Prices may change at any time, but changes do not affect orders we have already accepted.
5. Payment
We accept Visa, Mastercard, American Express, Discover, PayPal and Apple Pay. Payment is authorised at checkout and captured when your order is dispatched.
Card details are processed by a PCI-DSS compliant payment provider through hosted fields. We do not receive, see or store full card numbers or security codes. You confirm that you are authorised to use the payment method supplied.
6. Delivery, title and risk
Delivery times quoted on the shipping policy page are estimates, not guarantees, and begin from dispatch rather than from the moment you order. We are not responsible for delays caused by carriers, customs, weather or other events outside our reasonable control, though we will help you chase any parcel that goes astray.
Risk in the goods passes to you on delivery. Title passes when we have received payment in full.
7. Cancellation and returns
You may cancel an order at no cost before it is dispatched by emailing us with your order number. After dispatch, our returns and refunds policy applies: 30 days from delivery, unworn, tags attached, prepaid label on US orders.
UK customers additionally have a statutory 14-day right to cancel under the Consumer Contracts Regulations 2013, which runs alongside and does not reduce the 30-day window above.
8. Product descriptions and images
We describe our products as accurately as we can, including flat measurements, fibre content and country of manufacture. Colours can vary between screens, and natural fibres vary slightly between production runs. Minor variation of this kind is a characteristic of the material and is not a defect.
Where a piece is genuinely faulty, section 7 and our returns policy apply, and your statutory rights are unaffected.
9. Accounts
You are responsible for keeping your account password confidential and for activity carried out under your account. Tell us immediately if you believe your account has been used without your permission. We may suspend or close an account that is being used in breach of these terms.
10. Intellectual property
All content on this site, including product photography, text, garment designs, patterns and the Alden & Roe name and logo, belongs to us or is licensed to us. You may view and print pages for your own personal use. You may not copy, republish, sell or use our content commercially without written permission.
11. Limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
Subject to that, our total liability arising out of or in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, or for loss of profit, revenue or opportunity.
12. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Disputes will be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
If you are a consumer resident in the UK or the EU, you keep the benefit of any mandatory consumer protection provisions of the law of your country of residence, and you may bring proceedings there.
Before starting formal proceedings, please email hello@aldenandroe.com. Almost every dispute we have had was a misunderstanding that took one message to resolve.
13. Changes to these terms
We may update these terms from time to time. The version in force when you place an order is the version that applies to that order. The "last updated" date at the top of this page always reflects the current version.
14. Other policies
These terms should be read together with our privacy policy, shipping policy, returns policy and accessibility statement. If any provision of these terms is found unenforceable, the remaining provisions continue in force.
